Terms & conditions
1. Scope
Kukui GmbH (hereinafter referred to as “KUKUI”) provides all deliveries and services exclusively on the basis of these General Terms and Conditions (hereinafter referred to as “GTC”), in the version valid at the time of contract conclusion or order placement. By placing an order or a contract orally or in writing, the customer acknowledges these GTC. Written individual agreements deviating from these GTC between KUKUI and the customer remain reserved.
2. Orders & Availability
The offers and price information of KUKUI are non-binding and are considered only as an invitation to submit an offer. The customer’s order is binding. KUKUI is free to refuse the processing of an order at any time without stating reasons. In such cases, KUKUI will inform the customer. KUKUI does not guarantee the availability of ordered products.
3. Product Information
We place great importance on a complete and comprehensive description of our products. However, all product information is non-binding, and no liability is assumed for its accuracy, completeness, or timeliness. Information may be changed by KUKUI at any time. Similarly, quality standards, designations, origin information, samples, and prototypes of the products are non-binding and may be changed at any time.
4. Price Information
All prices are stated in Swiss Francs (CHF) (for Switzerland, Liechtenstein) or Euros (€) (for Germany, Austria, France, and other European countries), plus any applicable shipping costs. All prices are generally stated inclusive of VAT or sales tax (unless otherwise indicated).
5. General Delivery Conditions
Delivery is carried out via parcel logistics (e.g., Swiss Post, GLS) or via a freight forwarder. Deliveries that are not collected within a reasonable time after the first delivery attempt by the parcel service or freight forwarder will be returned to KUKUI. The purchase contract remains binding even in the case of a return of products. A new shipment of returned parcels (e.g., due to non-collection or incorrect address) will be charged at 25 CHF or €, regardless of the order value. Shipments are not insured against transport damage. KUKUI assumes no liability for transport damage. Delivery dates and times are indicative. Customers cannot derive any rights from non-compliance.

7. Taxes and Customs Duties
The prices for the main delivery countries (see above) include local taxes and customs duties. No additional costs are incurred.

8. Returns and Exchanges
Items ordered from KUKUI can be returned to KUKUI within 14 days of delivery.

9. Payment Conditions
KUKUI’s deliveries and services are carried out against invoice, credit card payment, prepayment via bank transfer, or another payment option offered in the webshop.
10. Retention of Ownership
The goods ordered remain the property of KUKUI until full payment is made. If the customer defaults on payment, KUKUI is entitled to withdraw from the contract and take possession of the goods.
11. Disclaimer of Liability
KUKUI assumes no liability for errors in images, prices, texts, or other content in sales documents, websites, price lists, newsletters, or other publications issued by KUKUI. KUKUI websites may contain links to third-party websites. KUKUI accepts no responsibility for such websites, their content, products, services, or compliance with data protection regulations. Activating a link is at the user’s own risk. KUKUI assumes no liability for delays, defects, or any indirect damages.
12. Warranty
Upon delivery of the goods to the carrier, KUKUI has fulfilled all its obligations arising from the customer’s order. Risks and benefits are transferred to the customer. The customer must inspect the goods upon receipt and notify KUKUI in writing of any defects within 7 days. For significant defects, the customer has the right to demand replacement or a price reduction. All other warranties are excluded as far as legally permitted. Products must be used only for their intended purpose.
13. Security and Privacy
All images used by KUKUI are protected by copyright and may only be used by the customer with KUKUI’s consent.

14. Applicable Law and Jurisdiction
The place of jurisdiction is Zurich. The registered office of KUKUI is the place of performance. Swiss law applies. These GTC come into effect on November 29, 2024, and replace all previous GTC of KUKUI valid up to this date.
