This Statement may be amended from time to time (see Section 8). If you continue to interact with us after we have made changes, this will be deemed acceptance of those changes; please therefore check the Statement regularly for updates.

  • Personal contact details: This includes all information you provide to us that enables us to contact you, such as name, postal address, email address, social network details or telephone number.
  • Account login data: Any information required to give you access to your specific account profile. Examples include your login ID/email address, your screen name, a password in non-decryptable format and/or security questions and answers.

  • Technical data about computers/mobile devices: Any information about the computer system or other technological devices you use to access one of our websites or apps, such as the Internet Protocol (IP) address used to connect your computer or device to the Internet, operating system type, and web browser type and version. If you access a kukui website or app via a mobile device such as a smartphone, the information collected also includes, where permitted, the specific device ID, advertising ID, geolocation and other comparable mobile device data from your phone.
  • Information about the use of websites/communications: As you navigate and interact with our websites and newsletters, we use automatic data collection technologies to collect certain information about your behavior. This includes information such as which links you click, which pages or content you view and for how long, and other comparable information and statistics about your interactions, such as response times to content, download errors and length of visits to certain pages.
  • User-generated content: This refers to content that you generate and then send to us by posting it on a social network or uploading it to one of our websites or apps, for which social network apps such as Facebook may also be used. We receive information about your social network profile (or parts of it) every time you download a kukui web application or interact with it on a social network such as Facebook, when you use features of a social network that is part of a kukui website (such as Facebook Connect), or when you interact with us through a social network. If you would like to learn more about how kukui receives your information from an external social network, or wish to prevent social networks from sharing this information in the future, please visit the website of the relevant social network.
  • Payment and financial information: Any information we need to process an order or that you use to make a purchase, such as your debit or credit card details (cardholder name, card number, expiry date, etc.) or other forms of payment (where available). We always handle payment and financial information in a manner consistent with applicable laws, regulations and security standards such as PCI DSS.

3. Ways in which we use your personal data

The following paragraphs explain the various purposes for which we collect and use your personal data, as well as the different types of personal data collected for each purpose. Please note that not all of the uses listed below are relevant for every user.

  • Customer service: We use your personal data for customer service purposes, including responding to your inquiries. This typically requires the use of certain personal contact details and information related to the reason for your inquiry (e.g. order status, technical aspects, questions/complaints about products, general questions, etc.).
  • Prize draws, marketing and other promotions: With your consent (where required), we use your personal data to send you information about products or services (e.g. marketing communications or campaigns or promotions). This may take the form of emails, ads, SMS, phone calls and postal mailings, to the extent permitted by applicable laws. Some of our campaigns and promotions may take place on third-party websites and/or social networks. This use of your personal data is voluntary, which means that you may object to the processing of your personal data for this purpose.
  • Social networks: We use your personal data when you interact with external social network features, such as the “Like” function, in order to send you advertisements and to contact you on social networks. You can learn more about how these features work and what profile data we obtain from you, and find out how to prevent future use, by reviewing the privacy statements of the relevant external social networks.
  • Personalization (offline and online): With your consent (where required), we use your personal data to (i) analyze your preferences and habits, (ii) anticipate your needs based on our analysis and your profile, (iii) improve and personalize your experience on our websites and apps to ensure that content on our websites/apps is optimized for you and your computer or device, and (iv) enable you to participate in interactive features if you wish.
  • Order fulfillment: We use your personal data to process your orders and ship products, inform you about the status of your orders, correct addresses, and carry out or have carried out identity checks and other fraud detection activities. This requires the use of certain personal data and payment information.
  • Other general purposes (e.g. internal research, analysis, security): We use your personal data, in accordance with applicable laws, for other general business purposes, such as conducting internal marketing and demographic studies and measuring the effectiveness of advertising campaigns. If you have multiple customer accounts, we reserve the right to merge them into a single account. We also use your personal data to ensure our security.
  • Legal reasons or mergers/acquisitions: In the event that kukui or its assets are acquired by or merged with other companies, such as in the case of insolvency, we may transfer your personal data to any of our successors in title. We are also entitled to disclose your personal data to third parties (i) where required by applicable law, (ii) in connection with legal proceedings, (iii) in compliance with an order from a competent law enforcement authority, (iv) to protect our rights, privacy, safety or property or those of the public, or (v) to enforce the terms of agreements or of our website.

4. Disclosure of your personal data

Apart from kukui, we share your personal data with the following types of external organizations:

  • Service providers: These are external companies that we engage to support us in carrying out our business (e.g. order fulfillment, payment processing, fraud detection and identity verification, debt collection, website operation, support services, promotions, website development, data analysis, CRC, etc.). Service providers and their selected personnel are only permitted to access and use your personal data on our behalf, for the specific tasks they have been commissioned to perform and on the basis of our instructions; they are also obliged to treat your data confidentially and securely. Where required by applicable law, you can obtain a list of the providers that process your personal data.
  • Credit reporting agencies/debt collection companies: Credit reporting agencies and debt collection companies are external companies that we engage, to the extent permitted by applicable law, to help us assess your creditworthiness (particularly for orders on invoice) or collect outstanding invoices.
  • Third-party companies that use personal data for their own marketing purposes: Except in cases where you have given your consent, we do not permit any third-party companies to use your personal data for their own marketing purposes, nor do we sell this data for such purposes.

5. Retention of your personal data

We use your personal data, in accordance with applicable laws, for as long as necessary to fulfill the purposes for which it was collected (as explained in Section 3 above) or to comply with applicable legal requirements.

6. Storage and/or transfer of your personal data

We take a number of appropriate precautions (as described below) to ensure the confidentiality and security of your personal data. Please note, however, that these safeguards do not apply to information that you voluntarily post in publicly accessible environments such as social networks.

  • Employees who can access your personal data: Your personal data is processed by our authorized personnel on a need-to-know basis, depending on the specific purposes for which your data was collected (for example, our personnel responsible for customer service matters have access to your customer record).
  • Precautions taken in operating environments: We store your personal data in operating environments that have appropriate security measures in place to prevent unauthorized access. We adhere to appropriate standards to protect personal data. Unfortunately, the transmission of information over the Internet is not completely secure, and although we do our best to protect your personal data, we cannot guarantee the security of data during its transmission through our websites/apps.
  • Measures we expect you to take: It is important that you also play a part in ensuring the protection and security of your personal data. When you register for an online account, please make sure to choose a password that is difficult for others to guess, and never share your password with anyone else. You are responsible for maintaining the confidentiality of this password and for all use of your account. If you use a computer that is shared with others or publicly accessible, never choose the setting that saves your login ID/email address or password, and make sure to log out of your account each time you leave the computer. You should also make use of the privacy settings or controls that we may offer you on our website/app.
  • Transfer of your personal data: The storage and processing of your personal data described above may require that your data is ultimately transferred/transmitted to and/or stored at a destination outside your country of residence, such as Switzerland or Luxembourg. To the extent permitted by applicable law, by accepting the terms of this Statement you consent to such transfers, transmissions, storage and/or processing. You also agree that these activities may lead to or take place in countries that offer a lower level of protection than your country of residence.

7. Access to your personal data

Where provided for by applicable law, you, your successors in title, representatives and/or agents have the right to access and review the information we hold about you and to request a physical or electronic copy of it. You may also have the right to request information about the source of your personal data. These rights may be exercised by sending us a message at kukui@kukui.ch or by writing to us at Kukui GmbH, Dienerstrasse 70, 8004 Zurich, enclosing a copy of your identity card or equivalent information (if requested by us and permitted by applicable law). If the request is submitted not by you but by another person without proof that they are acting lawfully on your behalf, it will be rejected. Please note that any identification information provided to us will be processed exclusively in accordance with applicable laws and only to the extent permitted by them.

Amendment and deletion of personal data: Where provided for by applicable law, you, your successors in title, representatives and/or agents may (i) request the deletion, correction or revision of your personal data, (ii) object to the processing of the data, (iii) restrict the use and disclosure of your personal data, and (iv) withdraw your consent to any of our data processing activities.

Please note that in certain situations we may not be able to delete your personal data without simultaneously closing your user account. After receiving your deletion request, we may be required to retain some of your personal data in order to meet our legal or contractual obligations. Applicable laws may also permit us to retain some of your personal data to cover our business needs. In some locations, our websites have a special feature that allows you to review and edit the personal data you have provided. Please note that we require our registered customers to verify their identity (e.g. login ID/email address, password) before they can access or make changes to their account information. This helps prevent unauthorized access to your account.

8. Changes to our Statement

If we change the way we handle your personal data, we will update this Statement. We reserve the right to make changes to our practices and to this Statement at any time, and you are therefore asked to check our Statement regularly for updates or changes.
