1. Scope
Kukui GmbH (hereinafter “KUKUI”) provides all deliveries and services exclusively on the basis of these General Terms and Conditions (hereinafter “GTC”), in the version valid at the time the contract is concluded or the order is placed. By placing an order or commission, whether verbally or in writing, the customer accepts the GTC. Individual written agreements between KUKUI and the customer that deviate from these GTC remain reserved.
2. Orders & Availability
KUKUI’s offers and prices are non-binding and merely constitute an invitation to submit an offer. The customer’s order is binding on the customer. KUKUI is free to decline to process an order at any time without giving reasons. In this case, KUKUI will inform the customer. KUKUI does not guarantee the availability of the ordered products.
3. Product information
We place great importance on a complete and comprehensive description of our products. Nevertheless, all product information is non-binding and no liability is assumed for the accuracy, completeness or timeliness of the information. Information may be changed by KUKUI at any time. Likewise, quality standards, designations, indications of origin, samples and specimens of the products are non-binding and may be changed at any time.
4. Prices
All prices are stated in Swiss francs (CHF) (for Switzerland, Liechtenstein) or euros (€) (for Germany, Austria, France and other countries in Europe), plus any shipping costs. All prices are generally stated including value added tax or sales tax (unless otherwise indicated).
5. General delivery terms
Delivery is made by parcel logistics (e.g. Swiss Post, GLS) or by freight forwarder. Deliveries that are not collected from the parcel logistics provider or freight forwarder within a reasonable time after the first delivery attempt will be returned to KUKUI. The purchase contract remains binding even if the products are returned. Re-delivery of parcels returned to KUKUI (e.g. due to non-collection or an incorrect address) will be charged at CHF/€ 25, regardless of the order value. Shipments are not insured for transport. KUKUI accepts no liability for transport damage. Delivery dates and deadlines are non-binding guideline times. The customer cannot derive any rights from a failure to meet them.

7. Taxes and duties
The prices for the Main Delivery Countries (see above) include local taxes and duties. No additional costs apply.

8. Returns and exchanges
Goods ordered from KUKUI can be returned to KUKUI within 14 days of delivery.

9. Payment terms
KUKUI’s deliveries and services are made against invoice, credit card charge, prepayment by bank transfer or another payment option offered in the web shop. Invoices are payable net, without deduction, within 30 days of the invoice date. Costs for reminders and default interest will be charged to the customer.
10. Retention of title for deliveries of goods
Goods ordered by the customer remain the property of KUKUI until paid in full. If the customer falls into default with payment of the purchase price, KUKUI is entitled without further ado to withdraw from the contract and take possession of the goods.
11. Exclusion of liability
KUKUI accepts no liability for errors in illustrations, prices, texts or other content of sales documentation, websites, price lists, information letters or other publications issued by KUKUI. KUKUI websites may contain links to third-party websites. Third-party websites may refer to KUKUI websites. KUKUI accepts no responsibility for such websites and their content, for the products, services or other offers they provide, or for compliance with data protection provisions. Activating a link is at the user’s own risk. KUKUI accepts no liability for late or non-delivery or for defects in devices or installations. KUKUI limits damages arising from its conduct and from its products to gross negligence and intent. Liability for indirect and consequential damages is excluded.
12. Warranty
Upon handover of the goods to the carrier, KUKUI has fulfilled all obligations arising from the customer’s order, and benefit and risk with regard to the goods pass to the customer. The customer is obliged to inspect the goods immediately upon receipt and to notify KUKUI in writing of any defects within 7 days of receiving the goods. In the case of defects that are not minor, the customer has the right to demand replacement delivery or a reduction of the purchase price. In all other respects, any warranty on the part of KUKUI is excluded to the extent permitted by law. The products may only be used for their intended purpose.
13. Security and data protection
All image material used by KUKUI is protected by copyright and may only be used by the customer with KUKUI’s consent.

14. Applicable law and place of jurisdiction
The place of jurisdiction is Zurich. KUKUI’s registered office is the place of performance. Swiss law applies. These GTC enter into force on 29 November 2024. They replace all GTC of KUKUI valid until that date.
